In a recent interview with the Disability Law Resource Project, Dr.
Troy Justesen, Acting Director, Office of Special Education Programs at the U.S. Department of Education (ED), stated that the proposed regulations on Part B of the Individuals with Disabilities Education Act
(IDEA) 2004 is expected to be released during the first or second week of June 2005. The IDEA Part B program is the Assistance to States for Education of Children with Disabilities program (3 through 21 years).
Once the notice of proposed rulemaking (NPRM) is published, the public will have 75 days to comment on the proposed regulations. IDEA 2004 becomes effective on July 1, 2005, and state education agencies and local education agencies are required to comply with the new law on this date, even in the absence of regulations.
